1. Agreement to Terms
These Terms and Conditions (“Terms”) form a binding agreement between you and Wera (“Wera,” “we,” “us,” or “our”) governing your access to and use of the Wera website, mobile applications, and related services (collectively, the “Platform”). By creating an account, booking a worker, accepting a placement, or otherwise using the Platform, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy.
If you do not agree to these Terms, do not use the Platform.
2. Definitions
- Household or Employer: a person who uses the Platform to find, book, or engage a home care professional.
- Worker or Home Care Professional: an individual offering services through the Platform, including nannies, housekeepers, cooks, mama fua, gardeners, and babysitters.
- Placement: the arrangement under which a Household engages a Worker following a booking made through the Platform.
- Placement Fee: the one-time fee paid by the Household to Wera for each booking, as described in Section 6.
- Trial Period: the seven-day in-home trial under the Premium booking option, described in Section 7.
3. Eligibility & Accounts
You must be at least 18 years old and legally able to enter into a binding contract to use the Platform. You agree to provide accurate, current, and complete information when registering and to keep your account information up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account.
Workers must additionally consent to and complete our verification process before being listed, as described in Section 5.
4. Our Role on the Platform
Wera is a placement platform. We verify Workers, facilitate introductions between Households and Workers, and process Placement Fees. We are not an employer of any Worker, and we are not a party to the employment relationship that arises between a Household and a Worker following a Placement. We do not direct or supervise Workers in the performance of their duties at a Household.
5. Worker Verification
Each Worker listed on the Platform consents to and completes a four-step verification process:
- National ID validation through Kenya's Integrated Population Registration System (IPRS).
- A criminal records check carried out by a licensed background-check provider.
- Reference calls with at least one previous employer.
- A seven-day in-home Trial Period after Placement, where the Premium option is selected.
While we apply careful verification standards, no background check can guarantee future behaviour. Households remain responsible for their own assessment and supervision of any Worker they engage.
6. Bookings & Placement Fees
The current Placement Fees are:
- Standard: KES 1,500, one-time, includes verified worker profile, ID and background check, contact release, and a 14-day replacement guarantee.
- Premium + 7-Day Trial: KES 3,500, one-time, includes everything in Standard plus a seven-day in-home trial, enhanced background check, free replacement if the trial fails, and trial-period compensation for the Worker.
Placement Fees are payable in advance via M-PESA. Fees are non-refundable except as expressly set out in Section 7 (Trial Period & Replacement).
We may change Placement Fees from time to time. Any change will apply to new bookings made after the change takes effect and will be displayed on the Platform.
7. Trial Period & Replacement
Under the Premium option, the Household and Worker begin a seven-day in-home Trial Period. If the Household decides during or immediately after the Trial Period that the Worker is not the right fit, the Household may request a free replacement Worker by notifying Wera in writing within the trial window. Under the Standard option, the Household may request a replacement within 14 days of the Worker's first day of work.
Workers are compensated for the trial days they have worked, regardless of the outcome of the trial. Replacement is offered once per booking. If no suitable replacement is available, Wera may, at its discretion, offer a credit toward a future booking.
8. Payments & M-PESA
All payments on the Platform are processed via M-PESA. By initiating a payment, you authorise Safaricom to process the transaction on Wera's behalf and acknowledge that M-PESA terms also apply to your transaction.
Wera does not take any commission on the salary you agree with your Worker. Salary is paid directly by the Household to the Worker and remains a matter between them.
Failed or reversed M-PESA payments may result in the immediate suspension of a booking until the matter is resolved.
9. Household as Employer
Following a Placement, the Household is the legal employer of the Worker for the purposes of Kenyan labour law. The Household is responsible for:
- Agreeing fair and lawful terms of engagement with the Worker, including salary, hours, leave, and any accommodation arrangements.
- Paying salary in full and on time.
- Providing a safe working environment.
- Complying with applicable statutory obligations, including NSSF, NHIF (or SHIF as applicable), and PAYE where required.
- Treating the Worker with dignity and respect.
10. User Conduct
You agree not to:
- Use the Platform for any unlawful purpose or to facilitate trafficking, forced labour, or any form of exploitation.
- Provide false, misleading, or fraudulent information, including impersonating another person.
- Circumvent the Platform by paying or accepting Placement Fees off-Platform after being introduced through Wera.
- Solicit personal information from other users for purposes unrelated to a Placement.
- Interfere with the Platform's operation, attempt to access data you are not authorised to access, or upload malware.
- Harass, intimidate, discriminate against, or abuse any other user.
11. Reviews & Content
You may submit reviews, ratings, photos, and other content (“User Content”) about your experience with the Platform. You agree that User Content is truthful, your own, and does not infringe any third-party rights. By submitting User Content, you grant Wera a non-exclusive, royalty-free, worldwide licence to host, display, reproduce, and adapt it for the purpose of operating and promoting the Platform.
We may remove User Content that is defamatory, discriminatory, obscene, or otherwise in breach of these Terms.
12. Suspension & Termination
We may suspend or terminate your account, at our discretion and without prior notice, if we reasonably believe that you have breached these Terms, that your continued use poses a risk to other users, or that suspension or termination is required by law. You may close your account at any time by contacting us.
Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnity, intellectual property, and governing law) will survive.
13. Disclaimers
The Platform is provided on an “as is” and “as available” basis. While we work hard to verify Workers and to keep the Platform reliable, we make no warranty that the Platform will be uninterrupted, error-free, or that any particular Worker will meet your expectations. We do not warrant the outcome of any Placement.
Nothing in these Terms excludes any liability that cannot lawfully be excluded under Kenyan law.
14. Limitation of Liability
To the maximum extent permitted by law, Wera's total aggregate liability to you arising out of or in connection with these Terms or your use of the Platform will not exceed the greater of (a) the Placement Fees you paid to Wera in the twelve months immediately preceding the claim, or (b) KES 10,000.
Wera will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, goodwill, or data, even if advised of the possibility of such damages.
15. Indemnity
You agree to indemnify and hold Wera, its directors, employees, and agents harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Platform, your User Content, or your conduct in connection with any Placement.
16. Intellectual Property
The Platform, including its name, logo, design, text, graphics, and software, is owned by Wera or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the Platform without our prior written consent.
17. Governing Law & Disputes
These Terms are governed by the laws of Kenya. Any dispute arising out of or in connection with these Terms will, if not resolved through good-faith discussion within 30 days, be referred to the courts of Kenya, which will have exclusive jurisdiction.
18. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified to you by email or through the Platform at least 14 days before they take effect. Continued use of the Platform after the changes take effect constitutes acceptance of the updated Terms.
